This is a rush transcript from “Special Report” October 12, 2020. This copy may not be in its final form and may be updated.

Good evening, welcome to Washington. I’m Bret Baier.

Breaking tonight, we are following three big stories at this hour. Just a short time ago, President Trump’s physician said the commander-in-chief has tested negative for the coronavirus on consecutive days. This as the president’s on his way to a rally in Florida as he restarts his campaign travel while his opponent, you see on screen there, Joe Biden holding a rally in another swing state Ohio.

Back here in Washington, the confirmation hearings for Judge Amy Coney Barrett began on Capitol Hill today with opening statements and plenty of political rhetoric setting the table for hours of questioning which starts Tuesday morning. Republicans on the Committee touted Judge Barrett’s status as a law professor and legal scholar.

Barrett bats away tough Democratic confirmation probing

WASHINGTON — Supreme Court nominee Amy Coney Barrett batted away Democrats’ skeptical questions Tuesday on abortion, health care and a possible disputed-election fight over transferring presidential power, insisting in a long and lively confirmation hearing she would bring no personal agenda to the court but decide cases “as they come.”

The 48-year-old appellate court judge declared her conservative views with often colloquial language, but refused many specifics. She declined to say whether she would recuse herself from any election-related cases involving President Donald Trump, who nominated her to fill the seat of the late Justice Ruth Bader Ginsburg and is pressing to have her confirmed before the the Nov. 3 election.

“Judges can’t just wake up one day and say I have an agenda — I like guns, I hate guns, I like abortion, I hate abortion — and walk in like a royal queen and impose their will on

CONCORD, N.H. — Health care advocates say the fate of the Affordable Care Act is on the line, as the first day of Senate confirmation hearings for Judge Amy Coney Barrett to the U.S. Supreme Court wrapped up.

President Donald Trump’s nominee would cement a 6-3 conservative majority on the high court. Marissa Padilla was principal deputy assistant secretary for public affairs at the U.S. Department of Health and Human Services during the Obama administration. She said if Coney Barrett is confirmed before the high court hears a case on the ACA on November 10, the law could fall.

And that would have major consequences for New Hampshire.

“Repealing it could threaten coverage for more than 570,000 Granite Staters with pre-existing conditions,” Padilla said. “Repealing the ACA could also kick more

Amy Coney Barrett confirmation: Trump’s nominee vows to be apolitical as Democrats warn of threat to health care

Democrats acknowledged there is little they can do to stop Barrett’s confirmation. So they seemed determined to use the hearings to portray Republicans as a threat to the Affordable Care Act, and the nomination as a last-ditch effort to save Trump should next month’s election lead to litigation in the Supreme Court.

On optics alone, Sen. Cory Booker (D-N.J.) seemed to speak for everyone when he said, “There is nothing about this that is normal.”

The nominee, who spoke for just 12 minutes, wore a black face mask for nearly the entire hearing. Several members of the Senate Judiciary Committee participated remotely, one because he has tested positive for the coronavirus. In a first, the Architect of the Capitol submitted a letter certifying that the hearing room met Centers for Disease Control and Prevention safety regulations.

And when the 48-year-old Barrett, nominated by Trump after Justice Ruth Bader Ginsburg’s death

Democrats put Obamacare center stage in Supreme Court confirmation battle

Washington — The nomination of Judge Amy Coney Barrett to the Supreme Court last week set into motion a fast-paced and fiercely political battle over the future of the high court, with Senate Democrats, who have few tools to block her confirmation by the GOP-controlled Senate, charging that a vote in favor of Barrett is a vote to kill the Affordable Care Act.

The future of Obamacare, the health care law implemented by President Barack Obama, has emerged as the key focus of Democrats as they work to shape Barrett’s nomination and elevate the stakes for the public in hopes of pressuring the GOP not to move forward with the confirmation process.

“This is about your health care. This is about whether or not the ACA will exist. This is about whether or not preexisting conditions will be continued to be covered,” former Vice President Joe Biden, the Democratic presidential
