Barrett vows to interpret laws ‘as they are written,’ as Democrats warn of threat to health care

Americans “deserve an independent Supreme Court that interprets our Constitution and laws as they are written,” Barrett told the Senate Judiciary Committee, laying out her judicial philosophy, which she has likened to that of her conservative mentor, the late Justice Antonin Scalia.

The Senate, led by Trump’s Republican allies, is pushing Barrett’s nomination to a quick vote before Election Day, Nov. 3, and ahead of the latest challenge to the Affordable Care Act, which the Supreme Court is to hear a week after the election.

Republicans also hope to seat Barrett quickly enough to hear any legal challenges after the election. Sen. Richard Blumenthal of Connecticut was among several Democrats demanding that Barrett pledge not to take part in any election case. She has made no such commitment.

Barrett will face questions on Tuesday after an opening day dedicated to opening statements.

Amy Coney Barrett confirmation: Trump’s nominee vows to be apolitical as Democrats warn of threat to health care

Democrats acknowledged there is little they can do to stop Barrett’s confirmation. So they seemed determined to use the hearings to portray Republicans as a threat to the Affordable Care Act, and the nomination as a last-ditch effort to save Trump should next month’s election lead to litigation in the Supreme Court.

On optics alone, Sen. Cory Booker (D-N.J.) seemed to speak for everyone when he said, “There is nothing about this that is normal.”

The nominee, who spoke for just 12 minutes, wore a black face mask for nearly the entire hearing. Several members of the Senate Judiciary Committee participated remotely, one because he has tested positive for the coronavirus. In a first, the Architect of the Capitol submitted a letter certifying that the hearing room met Centers for Disease Control and Prevention safety regulations.

Where do Democrats stand on health care price transparency?

COVID-19 has exacerbated the Achilles’ heel of our health care system: medical billing. Surprise charges abound in the wake of diagnostic testing, a problem President Trump is seeking to fix with a recent executive order that Republican lawmakers are endeavoring to codify, and a health care plan that puts transparency at the forefront of the conversation. 

“By improving transparency, we can increase competition, empower patients, and ultimately lower health care costs. I’m glad to join my colleagues in support of this bill which is a critical step toward achieving these important goals,” Sen. Jon Ernst, Iowa Republican, one of 11 sponsoring the bill, said in a statement.

Health care law on line at court, but is it likely to fall?

WASHINGTON (AP) — To hear Democrats tell it, a Supreme Court with President Donald Trump’s nominee Amy Coney Barrett could quickly get rid of the law that gives more than 20 million Americans health insurance coverage.

But that’s not the inevitable outcome of a challenge the court will hear Nov. 10, just one week after the election.

Yes, the Trump administration is asking the high court to throw out the Obama-era healthcare law, and if she is confirmed quickly Barrett could be on the Supreme Court when the court hears the case.

But even if the justices agree that the law’s mandate to buy health insurance is unconstitutional because Congress repealed the penalties for not complying, they could still leave the rest of the law alone. That would be consistent with other rulings in which the court excised a problematic provision from a law that was otherwise allowed to remain

Hartford HealthCare and Connecticut Children’s broaden partnership extending pediatric care

The top executives of Hartford HealthCare and Connecticut Children’s on Monday signed an agreement broadening a 25-year partnership to combine pediatric services with the hospital system’s extensive network across Connecticut.

“This is a continuation and expansion and formalization of an existing relationship,” James Shmerling, president of Connecticut Children’s, said at an announcement outside Hartford Hospital.

Jeffrey Flaks, president of Hartford HealthCare, promised investments and modernization of services at neonatal intensive care units as Connecticut Children’s services are moved into Hartford HealthCare facilities.

“We’re going to work perfect the hand-off when children become adolescents and adolescents become adults for their health care,” he said.

Hartford HealthCare includes two tertiary-level teaching hospitals, an acute-care community teaching hospital, an acute-care hospital and trauma center, three community hospitals, a behavioral health network and a multispecialty physician group.

Protecting educators and health care workers through strategic state stockpiles

As of this writing, 922 U.S. health care workers have died fighting COVID-19, with nearly one-third lacking adequate amounts of personal protective equipment (PPE) during the initial months of the disease’s outbreak. In those early months, global supply chain issues and the rapid depletion of Strategic National Stockpile (SNS) resources illustrated serious gaps in America’s pandemic preparedness. Today, we continue to feel the ramifications as parents, educators and students face an uncertain return to the classroom.

In the future, these shortages could be avoided through the creation of something similar to the SNS: Strategic State Stockpiles.

States need to play a larger role in pandemic preparedness to “fill the gap” if, and when, the federal government is unable to do so. They can build independent emergency medical stockpiles mirroring the SNS, but with an emphasis on low-cost, high-yield items such as PPE and portable ventilators. This would allow states to
